Terms of Use
End-User License Agreement for the ECS Finek construction operations platform.

1. Who provides the service
ECS Finek is operated by Serghei Caijbirna, an individual based in California, United States ("we," "us," or "our"). These terms apply to the ECS Finek website and hosted application. Questions may be sent to eco.company.solutions@gmail.com. If you use the service on behalf of a company, you represent that you have authority to act for that company. Users must be at least 18 years old.
2. Your license and account
Subject to these terms and your trial or paid access, we grant you a limited, non-exclusive, non-transferable right to use ECS Finek for your company's internal business operations. This is access to a hosted service, not a sale of the software. ECS Finek retains rights in its software, design and branding; you retain rights in your company's content.
Keep account details accurate and credentials private. Company administrators are responsible for inviting authorized users, assigning suitable permissions, setting access schedules and promptly disabling access when it is no longer needed. Notify us if you suspect unauthorized access.
3. Acceptable use
Do not use the service unlawfully, upload malicious content, access another company's information without authorization, bypass access controls, interfere with service operation, or copy or resell the platform without permission. Only upload information you are entitled to provide. Do not use the platform to store full payment-card details, passwords for third-party services, or information unrelated to its business purpose.
4. Trials, subscriptions and cancellation
The current standard plans are $499 per company per month or $5,089.80 per company per year, reflecting a 15% annual discount. Your checkout states the applicable price, billing period and recurring-payment authorization. The five-day free trial does not require a card and does not automatically create a paid subscription. A customer may purchase during the trial; the paid term begins immediately.
Paid subscriptions renew automatically according to the authorization at checkout until canceled. You can cancel auto-renewal from the billing page before the next renewal. Cancellation normally preserves access through the confirmed paid term; payment reversals or unresolved payment failures may affect access. Contact us about billing errors or refund requests. Refunds and any mandatory cancellation rights are governed by applicable law and any express terms presented at purchase; cancellation alone does not automatically issue a refund.
The Founding 200 offer terms explain eligibility and the annual price guarantee. Those specific offer terms govern that guarantee. Other price changes will be communicated before they apply to a renewal. Third-party subscriptions and separately priced optional services are not included unless explicitly stated.
5. Your data and responsibilities
You retain ownership of content you enter, import or upload. You authorize us to store, process and transmit that content as needed to provide the service, respond to support requests and carry out your instructions. Our Privacy Policy describes information handling.
You are responsible for the accuracy of budgets, estimates, job costs, invoices, schedules, approvals and other records, and for maintaining any records required for your business. Review reports and calculations before relying on them or sharing them. ECS Finek is a software tool and does not provide professional accounting, tax, legal or engineering advice or guarantee a financial outcome.
6. QuickBooks and other third-party services
Optional integrations require your authorization and may require a separate account with the provider. QuickBooks Online is provided by Intuit; Square processes subscription payments; email delivery uses an external provider. Their services are subject to their own terms and availability. ECS Finek is independently operated and is not Intuit or Square.
The current QuickBooks release supports connection and company verification in Sandbox. Live-company access and financial transaction synchronization are not enabled. Bills, expenses, customer invoices, payments and deletions are not synchronized by connecting an account. Future synchronization will require implementation and configuration; do not assume a document has reached QuickBooks without a confirmed result.
The company owner can disconnect QuickBooks from the connection page. Disconnecting does not cancel your ECS Finek subscription or delete records already held by either service. Separate data-deletion requests can be sent to our contact email.
7. Product changes and availability
We may improve or change the platform and perform maintenance. We do not promise uninterrupted or error-free service or a specific uptime level. Roadmap items, examples and demonstrations are not promises that a feature is available or will be delivered by a particular date. Choose your subscription based on the capabilities available at purchase.
8. Suspension and ending access
We may restrict access when reasonably necessary to address security risks, unlawful use, a material violation of these terms or unpaid charges. Contact us to resolve an access issue. Company administrators may also restrict individual users. Before ending use, export the records available through the platform and contact us for assistance with account closure or other data requests. Cancellation, disconnection and data deletion are separate actions; retention is described in the Privacy Policy.
9. Warranties and responsibility
To the extent permitted by law, the service is provided "as is" and "as available," without implied warranties of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that it will meet every business requirement. Nothing in these terms excludes liability or rights that cannot lawfully be excluded, including applicable consumer protections. Each party remains responsible for its conduct under applicable law.
10. Updates and contact
We will post revisions here with an updated date and provide notice of material changes through the service or account email before they take effect where required. Changes do not retroactively remove an applicable Founding 200 guarantee. These terms are governed by California law, subject to mandatory protections that apply to you.
